Terms and Conditions

Welcome to Dreamstai, a web-based interactive storytelling experience operated by Patterson Consulting LLC ("Company," "we," "us," or "our"). These Terms and Conditions govern your use of Dreamstai, including any related services and subscriptions. By using Dreamstai, you ("User," "Parent," or "Guardian") agree to these Terms.

1. Service Overview

Dreamstai is an AI-driven, interactive storytelling service for children, managed by parents. Parents create an account, set up profiles for their children, and allow access to Dreamstai on a device. The child's interactions with the system influence the storytelling experience.

2. Account Creation and User Eligibility

Only parents or legal guardians (18 years or older) may create an account.
Children do not create accounts; they access the service under parental supervision.
Parents are responsible for monitoring their child's interactions with Dreamstai.

3. Subscription and Payment

Dreamstai offers a one-week free trial (up to three sessions).
After the trial, a subscription fee of $17.50 per child per month or $180 per child per year if paying annually applies.
Auto-renewal is optional (monthly or annually). Users may cancel anytime.
No refunds will be provided for subscriptions once a billing cycle has started.

4. User-Generated Content (UGC) and AI Responses

Dreamstai incorporates both AI-generated content and child input.
While measures are in place to filter inappropriate responses, we cannot guarantee complete accuracy or appropriateness of AI-generated content.
Parents will receive daily digests and transcripts of their child's interactions.

5. Privacy and Data Usage

Parent account information (email, name) is collected via Google authentication.
Additional child-related details (age, likeness, favorites, preferences) are collected during onboarding.
All interactions are stored in Firebase and used to improve the personalized storytelling experience.
Dreamstai does not share, sell, or distribute user data outside of essential business partners (LiveKit, Firebase, OpenAI, ElevenLabs) required to provide the service.

6. Parental Controls and Monitoring

Parents can review, monitor, and delete their child's stored interactions at any time.
Inappropriate behavior or concerns raised by Dreamstai's monitoring system will be flagged and shared with parents.
Parents can terminate their account and data with a one-click option.

7. Legal Compliance (COPPA Considerations)

To comply with the Children's Online Privacy Protection Act (COPPA), we require both credit card verification and explicit declaration of parental/guardian status.
During account creation, you must confirm under penalty of perjury that you are the parent or legal guardian of any child whose profile you create.
False declarations of parental or guardian status are a violation of these Terms and may result in immediate account termination.
We comply with COPPA regulations by:
- Obtaining verifiable parental consent before collecting any child's personal information
- Providing parents complete control over their child's data
- Allowing parents to review all collected information
- Enabling parents to delete any or all child data
- Limiting data collection to what is reasonably necessary
Parents may request the deletion of stored child data at any time through their account settings.
Parents receive regular notifications about data collection practices and any updates to these practices.

8. Limitations of Liability

AI-generated content is not guaranteed to be 100% error-free. Dreamstai will take reasonable measures to ensure safety but is not liable for unintended responses.
We do not assume responsibility for user-generated input or child speech influencing AI responses.
To the fullest extent allowed by law, Patterson Consulting LLC is not liable for indirect, incidental, or consequential damages.

9. Termination and Cancellation

Users may cancel their subscription anytime through their account settings.
Upon cancellation, all stored child interactions will be deleted within a reasonable period.
We reserve the right to terminate accounts if users violate these Terms.

10. Governing Law

These Terms and any disputes arising from them will be governed by the laws of Iowa, USA.
